Online coaching contracts can be revoked: Consumer rights strengthened – refunds granted by court ruling


The verdict is final after the appeal is withdrawn.
The term “coachees” refers to customers of online coaching, i.e., people who have booked digital coaching packages such as “business building”, “mindset” or “digital reselling”.

A contract for online coaching can be effectively revoked.
The verdict is legally binding, as the appeal was withdrawn.
Consequence: Payments already made must be refunded, and there is also no obligation to make installment payments.

The court’s reasoning:


Those who are still in the orientation or planning phase and do not already run a business remain consumers – and therefore entitled to withdraw from the contract.
A distance selling contract (concluded online or by telephone) is generally subject to the right of withdrawal.
Important: This includes not only “digital content” but also personal services such as live calls, 1:1 coaching or WhatsApp support.
A blanket waiver of the right of withdrawal via checkbox is generally ineffective for coaching services.
Furthermore, the following applies: Without proper notification of the right of withdrawal, the period does not even begin.
The right of withdrawal does not expire as long as the coaching has not been fully completed.

Checklist for coachees:

  1. Back Up All Documents (contracts, Order Process/screenshots, Terms and Conditions, Invoices, Chats, Emails).
  2. Check: Did you really want to start a business or were you just gathering information?
  3. Declare your cancellation in writing (letter or email), request a refund and stop ongoing payments.
  4. Check contract clauses: Checkboxes for waiving the right of withdrawal are usually invalid.
  5. When you receive a payment reminder, stay calm, have it legally reviewed first, then react.

How to recognize problematic coaching offers:

  • Exaggerated Profit Promises (“income on Autopilot”, “110% Success Guarantee”)
  • Pressure to sign a contract immediately over the phone
  • Unclear Contractual Partners (coach, Intermediary or Reseller)
  • Opaque or misleading cancellation checkboxes
  • Allegedly only digital content, although in reality personal support takes place.

Conclusion:

Consumers can exercise their right of withdrawal in the case of online coaching sessions.
Consequence: Reimbursement of amounts paid and exemption from all further installments.
