In 2021, the new Interstate Treaty on Gambling came into force, imposing a uniform monthly deposit limit of €1,000 per player in Germany – regardless of the platform or provider. What few people know is that such a limit has actually been in place since the previous Interstate Treaty on Gambling from 2012. Therefore, it may be possible to reclaim gambling losses retroactively for up to 10 years if it can be proven that more than €1,000 was deposited per month.
The deposit limit serves a good purpose: it is intended to protect players from addiction and excessive debt. Online gambling providers are legally obligated to implement appropriate technical measures to monitor their users’ deposit behavior and ensure compliance with the limit. Those who fail to comply are breaking the law – and may be liable for damages .
What exactly does a limit violation mean?
A limit violation occurs when a player deposits more than €1,000 within a calendar month – and the casino still allows him to continue playing.

The maximum limit of €1,000 per month is specifically intended to prevent extreme losses and thus limit the negative consequences of gambling addiction for the player, as well as their family and creditors […]”
