What is an inheritance dispute or partition action?

An action for partition of an estate, also known as a partition action or inheritance division action, is a legal remedy when a community of heirs cannot agree on the division of the estate. Who is suing whom?

The lawsuit is brought by the co-heirs who agree with the distribution plan. The defendants are the co-heirs who object to the distribution plan. If the defendants do not agree to the distribution plan, the court decides. If a judgment is rendered in favor of the plaintiffs, the estate is divided accordingly.

Filing of the lawsuit

– Mediation: Disputes can be settled through professional mediation.

– Selling an inheritance share: Selling an inheritance share to a co-heir or a third party is often a quick and cost-effective solution. The co-heirs have a right of first refusal.
