In a significant ruling, the Frankfurt Regional Court has once again clarified that sports betting providers are obligated to comply with legal deposit limits.
A sports betting provider must repay a player €18,710 because he violated the legal deposit limit. The ruling strengthens the rights of consumers who have suffered significant losses despite existing protective mechanisms.
The plaintiff regularly placed bets on a betting platform operated by the defendant between November 2020 and January 2022. Although the Interstate Treaty on Gambling stipulates a monthly deposit limit of €1,000, the defendant allowed the plaintiff to deposit funds far exceeding this limit. The total amount of these unauthorized bets was €18,710. The court clarified that the company should have ensured that the plaintiff did not exceed the monthly limit. Since this did not occur, the player is entitled to a refund.
Many sports betting providers now hold a license to offer online sports betting. However, a license does not mean that providers are allowed to disregard legal protection regulations. This is precisely where the Frankfurt Regional Court’s ruling comes in: Any provider who violates the protective mechanisms of the Interstate Treaty on Gambling is liable.

The deposit limit serves to protect players from financial over-indebtedness and gambling addiction. The court emphasized that this regulation is a contractual ancillary obligation in the form of a protective provision. Exceeding the limit would only have been permissible under very specific circumstances, which were not present in this case. Since the sports betting provider did not offer the plaintiff the option of setting a limit and the legal limit was exceeded, the provider was ordered to repay the entire amount exceeding the limit.
