The Higher Regional Court of Cologne reaffirmed in January 2026 that providers such as Tipico, who offer online gambling without a German license, are obliged to fully reimburse lost stakes. In the case in question, a player received approximately 25,600 euros back. At the same time, experts warn that the statute of limitations for losses from 2016 will expire in 2026. The Higher Regional Court of Cologne has upheld the conviction of Tipico Games Limited to repay approximately 25,600 euros to a player. The plaintiff had used online gambling on the provider’s German-language platform between June 2014 and October 2020 and lost the corresponding amount. The court thus fully upheld the decision of the Aachen Regional Court.<\/p>\n\n
The reasoning of the Higher Regional Court corresponds to the now established case law of the Higher Regional Courts: Since Tipico Games Limited did not possess a German license for online gambling during the relevant period, the concluded contracts were invalid.
