The court ruled that the daughter was entitled to prohibit the placement of such items and to remove them, as the choice of a tree burial site reflected the deceased&#8217;s wish to comply with the cemetery regulations.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>What does funeral care mean?<\/strong><\/h2>\n\n<p>The duty to care for the deceased is both a customary right and a legal obligation. It encompasses the right to dispose of the body and includes, in particular, the duty to organize the funeral. This includes decisions regarding the type of burial, the location of the final resting place, and any necessary reburials or exhumations.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Who has the right to care for the dead?<\/strong><\/h2>\n\n<p>If the deceased has not expressly designated a person to handle the funeral arrangements (e.g., through a funeral directive), the next of kin decides according to unwritten custom. &#8220;This is usually the spouse, but it can also be a long-term partner. The right to arrange the funeral is independent of inheritance law,&#8221; explains lawyer Istv\u00e1n Cocron.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>How should decisions be made?<\/strong><\/h2>\n\n<p>The wishes of the deceased are paramount. The deceased can determine not only the manner and location of their burial, but also who should carry out these decisions. The person designated by the deceased may enforce these wishes even against the wishes of other relatives. If the wishes of the deceased are unknown, the person responsible for funeral arrangements can decide on the type of burial and the location of the final resting place. A wish can be inferred from the circumstances, even in the absence of a written declaration.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>How can disputes be avoided?<\/strong><\/h2>\n\n<p>A clear, written agreement made while still alive (e.g., via a funeral directive) provides certainty about the wishes of the deceased.<\/p>\n\n<p>1. Write down and sign your wishes regarding the funeral and grave maintenance in a funeral directive. Here you can specify details about the funeral service, eulogist, floral arrangements, grave maintenance, obituaries, guests, etc.<\/p>\n\n<p>2. Designate a trusted person as your authorized representative for funeral arrangements, so that they can enforce your wishes if necessary, even against the will of other relatives.<\/p>\n\n<p>3. To avoid misunderstandings, formulate your funeral instructions clearly.
