KG<\/strong> has once again achieved a significant ruling before the Ellwangen (Jagst) Regional Court: A defrauded player will receive more than 110,000 euros back from illegal sports betting.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Background of the case:<\/strong><\/h2>\n\n<p>The plaintiff had gambled with a well-known online sports betting provider for years and suffered massive losses. Although the <strong>Interstate Treaty on Gambling (Gl\u00fcStV)<\/strong> stipulates a <strong>monthly deposit limit of \u20ac1,000<\/strong> \u2013 in exceptional cases up to <strong>\u20ac30,000<\/strong> after prior review \u2013 these limits were ignored. In some cases, monthly deposits exceeding \u20ac14,000 were possible.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Key findings of the court:<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Legal violations:<\/strong> Online betting contracts without a German license or with excessive limits are <strong>void<\/strong> (\u00a7 134 BGB).<\/li>\n\n\n\n<li><strong>Player protection:<\/strong> The limit requirements (\u00a7 4 para. 5 Gl\u00fcStV 2012, \u00a7 6c Gl\u00fcStV 2021) expressly serve to protect against gambling addiction and ruinous losses \u2013 they are also intended to protect players <strong>\u201cfrom themselves\u201d<\/strong> .<\/li>\n\n\n\n<li>A <strong>Maltese license<\/strong> is not sufficient in Germany; a <strong>German concession<\/strong> is required.<\/li>\n\n\n\n<li><strong>The decisive factor<\/strong> is the exceeding of limits: The fact that the plaintiff was regularly able to deposit far above the permissible amount shows that the offer was &#8220;fundamentally not eligible for authorization.&#8221; Even with a German license, the authorities would have had to intervene.<\/li>\n\n\n\n<li><strong>No exclusion of the right to claim restitution:<\/strong> The player cannot be accused of intentionally unlawful conduct. An average user is not required to know that a foreign license is invalid in Germany. Therefore, the so-called <strong>bar to unjust enrichment (\u00a7 817 BGB)<\/strong> does not apply.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Meaning for players:<\/strong><\/h2>\n\n<p>This ruling is part of a growing number of decisions <strong>strengthening player protection<\/strong> .
